SCRD to appeal court ruling on Sakinaw Lake permit matter

On Dec 9, the Sunshine Coast Regional District (SCRD) notified Coast Reporter that it has decided to appeal the Dec. 1 Supreme Court decision related to permitting on Lorna Vanderhaeghe’s residential property at Sakinaw Lake.

On Dec 9, the Sunshine Coast Regional District (SCRD) notified Coast Reporter that it has decided to appeal the Dec. 1 Supreme Court decision related to permitting on Lorna Vanderhaeghe’s residential property at Sakinaw Lake. 

“As a result, the matter remains before the courts, and it would be inappropriate to comment further,” regional district communications manager Aidan Buckley wrote in an email.

No indication of timing for the filing of that appeal was provided. The BC Courts website details that filing notice of an appeal or requesting right to appeal must be done within 30 days of the decision. 

Included in Justice Emily Burke’s written reasons for that judgment were orders that the SCRD process Vanderhaeghe’s request to amend permits related to construction at 4355 Lake Road. It also dismissed the SCRD’s requests that the court impose actions on the property owner.

The history of the planned redevelopment of the property and related disagreements between the owner and the regional district date back to 2016.  Vanderhaeghe filed for court action in 2021.
